1. Acceptance of Terms

By accessing or using the Albair HVAC website (albair.ca) or engaging our HVAC services, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our website or services.

These terms apply to all visitors, customers, and others who access or use our services. Albair HVAC Inc. reserves the right to update these terms at any time. Continued use of our services after any changes constitutes your acceptance of the revised terms.

2. Services

Albair HVAC provides heating, ventilation, and air conditioning (HVAC) installation, repair, and maintenance services to residential and commercial customers in the Greater Toronto Area. Specific services, pricing, and availability are subject to change without notice.

Booking a service through our website or by phone constitutes a service request — not a binding contract. We will confirm availability and provide written confirmation of the appointment, scope, and pricing before work commences.

3. Quotes and Pricing

• All pricing shown on this website (including maintenance plan fees and tune-up pricing) is provided for general reference and subject to change
• Quotes provided by phone or email are valid for 30 days unless otherwise stated
• On-site assessments may reveal additional scope or required work not captured in an initial quote — any changes will be communicated and approved before proceeding
• Emergency service rates may differ from standard rates and will be disclosed before dispatch

4. Appointments and Cancellations

We ask that you provide at least 24 hours notice if you need to cancel or reschedule an appointment. Cancellations with less than 24 hours notice may be subject to a service call fee to cover our technician's time and travel.

We make every effort to arrive within your scheduled window. In the event of an unforeseen delay, we will contact you as early as possible to discuss options.

5. Payment Terms

• Payment is due upon completion of each service visit unless a prior credit arrangement has been established
• We accept major credit cards, debit, electronic transfer, and cheque
• Annual maintenance plan fees are billed in full at the start of each plan year
• Overdue accounts may be subject to interest at a rate of 1.5% per month (18% per annum)
• Returned cheques or failed electronic payments will incur a $45 administration fee

6. Warranties and Guarantees

Labour Warranty: We warrant our labour for 90 days from the date of service. If a problem recurs due to a workmanship defect within this period, we will return to correct it at no charge.

Parts Warranty: Parts and equipment are covered by the respective manufacturer's warranty. We will assist you in processing warranty claims for parts we supply, but manufacturer decisions are beyond our control.

Equipment Installations: New equipment installations include a minimum 1-year labour warranty. Extended labour warranty options may be available — ask your technician for details.

Warranties are void if the equipment is modified, misused, or serviced by an unauthorized party after our work is completed.

7. Limitation of Liability

To the maximum extent permitted by applicable Ontario law, Albair HVAC's liability for any claim arising from our services is limited to the amount paid for the specific service giving rise to the claim.

We are not liable for:

• Pre-existing conditions in your HVAC system or property that were not caused by our work
• Damage resulting from equipment failure after we have completed and the customer has accepted our work
• Consequential, indirect, or incidental damages of any kind
• Losses arising from circumstances outside our control (power outages, extreme weather events, third-party interference)

8. Website Use

You may use our website for lawful purposes only. You agree not to:

• Use the site in any way that could damage, disable, or impair its operation
• Attempt to gain unauthorized access to any part of the site or its underlying systems
• Transmit any unsolicited or unauthorized advertising or promotional material
• Misrepresent your identity or affiliation when submitting contact forms

All content on this website — including text, images, logos, and code — is the property of Albair HVAC Inc. and may not be reproduced without written permission.

9. Maintenance Plans

Annual maintenance plans are subject to the following additional terms:

• Plans are non-transferable and cover one residential address
• Multi-system properties require separate plan enrollment for each additional system
• Plans auto-renew annually at the current rate unless cancelled in writing at least 30 days before the renewal date
• Cancelled plans are not eligible for pro-rated refunds — coverage continues until the end of the paid term
• Priority scheduling benefits apply during normal business hours; emergency dispatch prioritization is subject to technician availability

10. Governing Law

These terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Ontario.
